HRSCANNER PRIVACY POLICY FOR APPLICANTS

INTRODUCTION

Welcome to Hrscanner Privacy Policy for Applicants! Here we explain what data we collect when you follow the link from your Employer to the internet service «Hrscanner» and go through Testing and/or record a Video Interview. We also explain why we collect this data and who your data is shared with. Please read over this and contact us with any questions regarding this document. Please review this Privacy Policy and signify your acceptance with it.

This Privacy Policy (hereinafter - the Privacy Policy) describes how your Personal Data that we may hold about you, is collected, used, stored, disclosed, and removed (each and all referred to as "processing"), determines the procedure for processing the Personal Data of the Applicant, establishes the obligations of the Provider to not disclose and ensure the regime for protecting the confidentiality of Personal Data that the Applicant provides to the Provider when passing the Test and/or recording the Video Interview on the Platform.

By using the Platform and/or Website you consent to the data practices described in this Privacy policy.

The Personal Data received from Applicants in EU countries is protected by the EU General Data Protection Regulation (here, «GDPR»), and the Provider has taken all necessary measures to observe the GDPR privacy requirements therein.

Please note the Provider acts under the instruction of the Employers who will determine what Personal Data is collected and processed in order to provide the services. For more information about what information is being collected and why, please speak with your Employer.

You will be invited to participate in the Platform via an Applicant invite generated by the Employer. The Platform is provided via a secure platform which will be accessed through a secure link provided in the Applicant invite.

Only when you have read and understood the Privacy Policy, Terms of Service you will be asked to enter any Personal Data.

TERMS AND DEFINITIONS

Unless otherwise expressly defined in the context of this Privacy Policy, capitalized terms have the following meanings:

  • Platform - an Internet service owned by IP Torbosov Oleg Nikolaevich (PSRNIE: 317745600003360 TIN: 742201522728), that is a set of software and hardware for testing personnel under the name "Hrscanner", located on the Internet at: https://www.hrscanner.ru/.
  • Website - entire website at: https://www.hrscanner.ru/.
  • Testing - a process which enables the Applicant, being on the Platform, to answer the questions posed in the Test and/or record a Video Interview, which results are displayed in the personal account of the Employer.
  • Test - a formalized task, which is carried out in an automated interactive form within the Platform, based on it is possible to determine the level of development of certain qualities of the Applicant, as well as his knowledge, skills and abilities upon entry into employment and/or being in employment.
  • Video Interview - a video file created by the Applicant through the Platform, includes a recording of the image and performance of the Applicant, which is a self-presentation of the Applicant and (or) its answers to the questions of the Employer.
  • Employer - an individual or legal entity that sent the Applicant a link to the Platform to pass the Test an/or record a Video Interview.
  • Applicant - an applicant for a job at the Employer’s enterprise or current employee which is given the opportunity to undergo Testing and/or recording a Video Interview using the Platform.
  • Processing of Personal Data - any action (operation) or a set of actions (operations) performed using automation tools or without using such tools with Personal Data, including collection, recording, systematization, accumulation, storage, clarification (updating, changing), retrieval , use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of Personal Data.
  • Personal Data - any information relating directly or indirectly to a specific as an identified or identifiable natural person (subject of Personal Data).
WHAT PERSONAL DATA IS COLLECTED AND IT’S PURPOSES?

With regard to each of your visits to the Platform and/or Website, the Provider will automatically collect the following Personal Data:

  • IP address;
  • Browser version;
  • Device Type;
  • Operating system version.

We collect this information to make sure Your devices support the ability to use our Platform. Without this information the Applicant will be unable to use the Platform.

When you use the link provided to You by the Employer to submit the Test and/or pass the Video Interview we may collect the following Personal Data from you:

*Personal Data may be requested on the demand of the Employer for specific vacancies and may vary from time to time.
Informing the Employer of Your eligibility criteria**

We collect this data in order to fulfill our contractual obligations with Employers to assist the Employers in the preliminary selection of the Applicants for vacancies and in the formation of a personnel reserve by storing the Applicant’s Personal Data, Test results and / or Video Interview recording in the Employer account.

In case we do need to process additional types of Personal Data about you, we will make sure that you are informed about the processing of your Personal Data and that there is a valid legal basis for doing so (for example, your consent).

If you object to the use of your Personal Data to fulfil any of the purposes set out above, please contact us. Whilst your decision to provide your Personal Data to the Provider is generally voluntary, if you do not provide certain information the Provider may not be able to accomplish some of the purposes outlined in this Privacy Policy.

WHAT IS THE LEGAL BASIS OF THE USE OF THE PERSONAL DATA?

Contractual Necessity: As required to establish and fulfil a contract with you (Terms of Service). Also to establish and fulfill a partnership contract concluded by the Employer and the Provider to assist the Employer in the preliminary selection of Applicants for vacancies of Employers and in the formation of a personnel reserve.

Consent: You will be asked to provide your consent for the Provider to collect and process your Personal Data. You will be provided with enough information to ensure that your consent is fully informed. You will not be asked to provide your consent until you have read and understood the Privacy Policy and you are encouraged to contact us or your prospective or current Employer if you have any questions in respect to the nature of the Platform and the extent of the processing of your Personal Data so that you can exercise choice and control.

You may withdraw your consent at any time and the Provider’s work have processes in place to deal with this.

Legitimate Interests: As required by it to pursue its own legitimate interests, in particular:

  • to help it monitor, improve, administer and protect our Platform, Website;
  • to monitor and ensure compliance by you with its policies and rules;
  • to monitor any use of the Platform and / or the Website by the Applicant to prevent, investigate and / or report fraud, terrorism, misrepresentation, security incidents or crime in accordance with applicable law.

Legal Compliance: To ensure compliance with applicable laws and the protection of the Provider's legitimate business interests and legal rights, including, but not limited to, use in connection with legal claims, compliance, regulatory, tax, investigative purposes (including disclosure of such information in connection with legal process or litigation).

WHO WILL YOUR PERSONAL DATA BE SHARED WITH?

The Personal Data of the Applicant is used by the Provider to transmit it to the Employer upon the passing of the Test by the Applicant and/or Video Interview recording.

The Applicant hereby instructs the Provider to transmit to the Employer all the answers to the questions given by the Applicant during the Testing and / or Video Interview recording.

This sharing will be for the purposes set out above or to comply with specific legal obligations to which we are subject.

The Provider uses appropriate safeguards to protect Personal Data which is transferred to Employers from the countries outside of the European Economic Area which are considered to provide a lower level of protection for personal information. European Commission-approved Standard Contractual Clauses and other legally acceptable transfer mechanisms are in place with our IT support and IT system maintenance suppliers.

Information about any third parties that have access to your Personal Data, as well as process your Personal Data on behalf of and on behalf of the Provider, you can request by contacting us by e-mail support@hrscanner.ru. We will respond promptly to any of your requests.

INTERNATIONAL DATA TRANSFERS

We store your information primarily within the European Economic Area. However, some features and requirements of the Platform, involve transferring your information to the Employers outside the European Economic Area. Where such Employers are not established in a country ensuring an adequate level of protection within the meaning of Regulation (EU) 2016/679, such as the United States, the transfers will be covered by the standard data protection clauses adopted by the European Commission or by another appropriate safeguard mechanism such as the Privacy Shield Framework.

WHAT COOKIES WILL BE USED ON THE WEBSITE?

The Website and/or Platform uses cookies (small files placed on website Applicants’ hard drive) to distinguish. This helps us to provide you with a high quality experience when you browse the Website and also allows us to improve the Platform and Website.

We offer certain services that are only available when using cookies. We use the following strictly necessary category of cookies:

For example, the Provider may store special information even after the completion of Testing and/or recording the Video Interview, if necessary to comply with our contactual obligations with the Employers, the requirements of the law, resolve a dispute, prevent fraud or abuse, and to ensure compliance with the provisions of this Privacy Policy.

HOW DO WE ENSURE YOUR PERSONAL DATA IS SAFE?

We take commercially reasonable efforts to maintain security protections in accordance with industry best practices to protect Personal Data we collect from loss, alteration, destruction, misuse, and unauthorized access or disclosure.

To prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of the Personal Data we collect, we have implemented physical, electronic, and administrative procedures. We utilize hashing, encryption techniques to help ensure your Personal Data is safeguarded.

We have policies to help maintain control and physical security of the facilities used to store data and only allow access to authorized personnel, restrict access to data to only those employees, contractors and agents that require it to provide and support our Platform. UPDATES OF THE PRIVACY POLICY

This Privacy Policy may be revised, modified, updated and/or supplemented at any time, without prior notice, at the sole discretion of the Provider.

By using our Platform, the Applicant automatically signify his/her acceptance of this Privacy Policy. If the Applicant does not agree to this Privacy Policy, we would require him not to use our Platform and/or Website.

PERSONAL DATA BREACH NOTIFICATION

In the event that your data is compromised, the Provider will notify affected Applicants within 72 hours by email with information about the extent of the breach, affected data, and any impact on the Platform, along with the Provider’s action plan for measures to secure the data and limit any possible detrimental effect on the data subjects.

«Personal Data breach» means a breach of security leading to the accidental or unlawful destruction, loss, alteration, or unauthorized disclosure of or access to Personal Data transmitted, stored, or otherwise processed in connection with the provision of the services.

REPORTING TIMELINE

In the event of Personal Data breach the Provider is obliged to notify the appropriate supervisory authority without undue delay and, where, feasible, not later than 72 hours after having become aware of it. In such situation you also shall be notified immediately.
